Terms and Conditions
INTRODUCTION
1.1. Welcome to the The Newcastle Show website located at tickets.newcastleshow.com.au (“Site”).
1.2. These Terms & Conditions govern the sale and purchase of tickets via the Site.
1.3. The Site is owned and operated by Newcastle Agricultural Horticultural & Industrial Association Inc (A.B.N. 85 194 365 274) (“The Newcastle Show”, “We”, “Our” and “Us”).
1.4. By purchasing tickets via the Site you are deemed to have read, understood and agreed to these Terms & Conditions and you agree that these Terms & Conditions represent a binding agreement between you (‘Ticket Buyer”) and The Newcastle Show.
1.5. The Newcastle Show reserves the right to change these Terms & Conditions at any time without notice.
GENERAL
2.1. In selling tickets via the Site, The Newcastle Show is a ticketing agent selling tickets on behalf of a third party event organiser, promoter and/or venue (“Event Organiser”) for a particular event (“Event”) and accordingly, to the fullest extent permitted by law, The Newcastle Show is not liable for any claims relating to any Event or ticket purchase, unless stated otherwise within these Terms & Conditions
CONDITIONS OF SALE
3.1. All tickets offered for sale by The Newcastle Show are sold on a first come first served basis and once a The Newcastle Show is showing an Event as ‘sold out’ no further tickets will be offered for sale. Some Event Organisers may offer tickets available for purchase ‘on the door or at the event’ however it is your responsibility to confirm this.
3.2. All tickets purchased via the Site are emailed to the Ticket Buyer’s nominated email address. It is the Ticket Buyer’s responsibility to print off and present a valid ticket at the Event for admission.
3.3. Any tickets purchased via The Newcastle Show must not be re-sold, offered for re-sale, be on-sold at a premium, offered as a prize or inducement, packaged or otherwise used for advertising, promotional or other commercial purposes, or given to any person other than the person named on the ticket, without the prior written consent of the The Newcastle Show (and the Event Organiser), which may be withheld in The Newcastle Show’s (or the Event Organiser’s) absolute discretion.
CONDITIONS OF ENTRY
4.1. A Ticket Buyer must hold a valid ticket purchased via the Site and may be required to produce valid photo identification which corresponds with the name on the ticket in order to be admitted to the applicable Event.
4.2. If the Event is an over 18’s event you may be required to show valid photo identification prior to entry.
4.3. The Event Organiser reserves the right to refuse entry to any person who does not hold a valid ticket, valid photo identification, who arrives late, who is intoxicated, or who is not on the guest list.
4.4. The Event Organiser reserves the right to eject any Ticket Buyer from the applicable Event (in their sole discretion), in accordance with the law.
4.5. The Event Organiser shall be entitled to only admit latecomers to its event during a suitable break, or as it otherwise determines in its sole discretion.
4.6. The Event Organiser reserves the right to determine whether a Ticket Buyer may or may not bring cameras or other recording equipment to the applicable Event. Any restrictions in relation to cameras and recording equipment will be notified to the Ticket Buyer prior to, or at the Event.
4.7. Ticket Buyers are required to retain their tickets throughout the applicable Event and may be asked to present their ticket at any time during the Event.
4.8 Ticket Buyers and their guests are required to comply with any applicable COVID-19 public health orders in place from time to time. It is the Ticket Buyers sole responsibility to check the most up to date public health orders in place at the time of purchase and attending the applicable Event.
REFUNDS, EXCHANGES AND REPLACEMENTS
5.1. Subject to the further terms of this Clause 5, all tickets purchased via the Site are non-refundable and non-exchangeable unless the Event Organiser permits a refund or exchange, or unless the Event Organiser is legally required to do so. In the event that the Event Organiser does provide a refund or exchange, it may be subject to certain conditions and additional fees.
5.2. The Newcastle Show and the Event Organiser are under no obligation to replace lost or stolen tickets for any tickets sold via the Site.
5.3. If the applicable Event is cancelled for any reason, tickets for that particular event shall be refunded by The Newcastle Show acting as agent for the Event Organiser, or the Event Organiser (where the Event Organiser collects ticket funds directly).
5.4. The Newcastle Show and/or the Event Organiser shall be under no obligation to arrange a substitute or replacement for a cancelled Event.
5.5. If the Event is re-scheduled, you will be contacted via your nominated email address and notified of such re-schedule. It is your responsibility to ensure that you keep your contact details up to date by notifying The Newcastle Show. The Event Organiser and/or The Newcastle Show shall not be responsible for failure to contact you in the event that your contact details have changed and you have not updated your contact information or accessed your email account. If the Event is re-scheduled you shall not be entitled to a refund or exchange unless agreed by the Event Organiser, or unless the Event Organiser is required by law to do so.
5.6 The Ticket Buyer acknowledges that in the instance where a refund is provided, to the fullest extent permitted by law, The Newcastle Show is entitled to retain the booking fee and any credit card processing fees associated with the issuing and refunding of that ticket.
OUR RIGHT TO CANCEL TICKETS
6.1. If we believe that a ticket sold using the Site was purchased fraudulently, we reserve the right to cancel such ticket in our sole discretion without notice to the Ticket Buyer.
VARIATIONS TO EVENTS
7.1. The Event Organiser reserves the right to vary, substitute or withdraw advertised programs, artists, venues, seating arrangements, capacity or the like, as necessary for any Event ticketed through the Site.
7.2. Any changes or variations pursuant to Clause 7.1 above shall be notified to Ticket Buyers for that Event prior to the commencement of the Event via the Site
PAYMENT & PURCHASE OF TICKETS
8.1. At the point of purchase all ticket prices are listed in Australian dollars and are stated inclusive of GST and The Newcastle Show booking fees, except where otherwise stated.
8.2. The Newcastle Show accepts the following methods of payment for ticket purchases via the Site: external payment gateways including PayPal, Stripe along with direct payment options at the discretion of the Event Organiser.
8.3. All bank charges and fees incurred by a Ticket Buyer in connection with the purchase of a ticket via the Site shall be the sole responsibility of the Ticket Buyer.
NO WARRANTIES & DISCLAIMER
9.1. The Site is provided on an “as is” basis and without representations or warranties of any kind to you, whether express or implied, including without limitation as to the quality and/or fitness of the Site for a particular use, accessibility, or warranties that access or use of the Site will be uninterrupted or error-free, or that the Site will be secure or free of viruses or other harmful material or elements, or that any of the content on the Site will be correct, accurate, timely or complete.
9.2. The Site may include technical inaccuracies or typographical or other types of errors. The Newcastle Show has the right to make changes, modifications and updates to any materials contained on the Site in its sole discretion and without prior notice.
9.3. Except as expressly provided to the contrary in this Agreement, and to the fullest extent permitted by law, all terms, conditions and warranties whether implied, statutory or otherwise relating to this Agreement are excluded.
9.4. Except in respect of any ticket sales collected by us on your behalf, we will not be liable for any loss, including but not limited to loss of profits, or any loss of goodwill, custom or any incidental, special or consequential loss or damage suffered by you arising out of or connected to the provision of the Site.
9.5. Entry to and attendance to an event ticketed via the Site is at the Ticket Buyer’s sole risk. To the maximum extent permitted by law, The Newcastle Show shall not be responsible for any loss, damage, harm or injury arising from any Ticket Buyer’s, Event Organiser’s or Artist’s entry, attendance or performance at any event ticketed via the Site.
PRIVACY & TERMS OF USE
10.1. The Newcastle Show collects your individual information so it may contact you in the event of cancellation or variation to an Event. All personal information is held by The Newcastle Show in accordance with its Privacy Policy.
10.2. These Terms and Conditions incorporate and are to be read in conjunction with The Newcastle Show’s Site Terms of Use and the The Newcastle Show Privacy Policy.
GOVERNING LAW AND JURISDICTION
11.1. These Terms & Conditions and the access and use of the Site shall be governed by and construed in accordance with the laws of New South Wales, Australia. By accessing and using the Site, you accept that any dispute under these Terms & Conditions or arising out of access and/or use of the Site shall be subject to the exclusive jurisdiction of the New South Wales Courts in Australia and by accessing and/or using the Site, you hereby submit to the jurisdiction of such courts for such purposes.
11.2. The Ticket Buyer is solely responsible for compliance with any applicable laws of the country from which they access the Site.
